Definition |
Unemployment benefit and vocational integration allowance represent the amounts granted at the request of eligible persons, according to Law no. 1/1991, republished in 1994 and amended by the Government Priority Ordinance no. 47/1997, for 270 calendar days at most. The unemployment indemnity (according to Law no. 76/2002 on unemployment insurance system and employment stimulation in force since March 1, 2002) represents a partial compensation of the insured person's income, after losing the jobs or of the income of the graduates of educational institutions and who could not get jobs. The unemployed registered at the agencies for employment who do not receive unemployment indemnity if they are hired full time for more than 3 months after the date of registration at the agencies for employment, receive an activation allowance of 500 lei, not taxable. Support allowance represents the amount granted to the persons who got unemployment benefit, or vocational integration allowance and who could not find a job. It is granted for 18 months period at most (according to the Law no. 1/1991, republished in 1994 and amended by the G.P.O. no. 47/1997). |

Methodology |
According to Law no. 76/2002, with the modifications and completions subsequently, benefit from unemployment benefits:
A) unemployed - who cumulatively fulfill the following conditions:
- have a contribution period of at least 12 months in the last 24 months prior to the date of registration of the application;
- does not earn income or earn from activities authorized by law income less than the value the social indicator of reference, in force;
- do not meet the retirement conditions according to the law;
- are registered with the employment agencies work in whose territorial area they have their domicile, as the case may be, the residence, if they had the last job or they made income in that locality.
The amount of unemployment benefits for this category of unemployed, is an amount granted monthly, differentiated according to the contribution period as follows:
-75% of the value of the social reference indicator in effective on the date of its establishment, for persons with a contribution period of at least one year; the sum provided above adds an amount calculated by application to the average gross monthly basic salary per the last 12 months of the contribution period a percentage differentiated according to the contribution period:
-3% for at least 3 years;
-5% for at least 5 years;
-7% for the at least 10 years;
-10% for at least 20 years.
According to the Emergency Ordinance no. 17 of 23 February 2011, is the contribution period and the periods for which the employer is exempt, under the law, from payment contribution due to the unemployment insurance budget.
Unemployment benefits are granted for periods differentiated according to the contribution period as follows:
-6 months, for people with a contribution period of at least 1 year;
-9 months, for people with a contribution period for at least 5 years;
-12 months, for people with an internship contribution for more than 10 years.
B) assimilated unemployed - who meet cumulatively the following conditions:
- are registered with the employment agencies work in whose territorial area they reside;
- does not earn income or earn from activities authorized by law income less than the value the social indicator of reference, in force;
- do not meet the retirement conditions according to the law.
The amount of unemployment benefits for this unemployed category, is a fixed amount, monthly, representing 50% of the value of the social indicator of the reference in force at the date of its establishment and is granted for a period of 6 months. According to Law no. 118 of June 30, 2010 (updated), the amount of the unemployment benefit established in the conditions provided by law and in payment on the date of entry into force of this law or which is established or reinstated in payment after suspension, according to the legal provisions decreases by 15%. |
